Ascension Builders Ltd. (“ABL”), Jonathan Edward Simmons (“J. Simmons”), and Ashley Lynne Simmons (“A. Simmons”)(together, “the Simmonses”) contrary to section 14(5) of the Homeowner Protection Act (the “Act”), published information implying, suggesting or holding out in a manner that ABL is a Licensed Residential Builder (“LRB”) during the period of, or about, March 3, 2025, and December 10, 2025, without ABL being a BC Housing (“BCH”) LRB. On December 10, 2025, BCH issued Compliance Order 25-0025 to ABL and the Simmonses, directing that ABL and the Simmonses:
- immediately cease all signage, marketing, and other publications that imply, suggest, or hold out in any manner that ABL or the Simmonses are a LRB; or
- immediately become a BCH LRB pursuant to section 14 of the Act.
ABL and the Simmonses were ordered to comply with Compliance Order 25-0025 by January 16, 2026.
