Back Forty Project Corp. (“BFP”), Dairn Fisher (“D. Fisher”) and Julie Fisher (“J. Fisher”) constructed a new home in Kelowna, BC (the “New Home”), between the period of, or about, March 11, 2024, and January 31, 2025. Although BFP has been approved as a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) 52359 since August 11, 2023, and obtained a commitment from an approved home warranty insurer on August 11, 2023, to provide home warranty insurance (“HWI”) on the New Home as required by the Homeowner Protection Act (the “Act”) and the Homeowner Protection Act Regulation (the “Regulation”), the New Home was de-enrolled from HWI coverage by the home warranty insurer on January 31, 2025, contrary to section 22(1) of the Act. On May 23, 2025, BCH issued Compliance Order 25-0014 to BFP, D. Fisher and J. Fisher directing that BFP, D. Fisher and J. Fisher:
- Immediately:
- Register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act; or
- Provide BCH Compliance Department with proof that the New Home is enrolled in a policy of HWI pursuant to section 22 of the Act.
BFP, D. Fisher and J. Fisher were ordered to comply with Compliance Order 25-0014 by June 13, 2025.
