Jortani Developments Inc. (“Jortani”) and Jaswinder Singh Cheema (“Cheema”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between approximately April 20, 2025, and June 11, 2026, in relation to the construction of a new home in Mission, BC (the “New Home”). On April 1, 2026, contrary to section 22(1) of the Act, the New Home was de-enrolled from home warranty insurance (“HWI“). Jortani and Cheema continued construction on the New Home without the New Home being registered for coverage by HWI provided by a warranty provider, thereby breaching section 22(1) of the Act. On June 11, 2026, BCH issued Compliance Order 26-0006 (the “CO”) to Jortani and Cheema directing that Jortani and Cheema:
- ensure all construction activities cease on the New Home; and
- immediately become a BCH Licensed Residential Builder pursuant to section 14(1) of the Act and register the New Home for coverage by HWI provided by a warranty provider pursuant to section 22(1) of the Act.
Jortani and Cheema were ordered to comply with Compliance Order 26-0006 by July 10, 2026.
