Compliance Order

Ben Bouchard Contracting Ltd. (“BBCL”), Benoit Raymond Bouchard (“B. Bouchard”) and Nancy Sue Bouchard (“N. Bouchard”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Powell River, BC (the “New Home”), between the period of, or about, October 2017 and June 2019, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Benbow Enterprises (2013) Ltd. (“BEL”) and John Stevenson Benbow (“Benbow”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, August 31, 2020, and February 3, 2021, regarding two new homes in Pemberton, BC (the “New Homes”).

Benbow Enterprises (2013) Ltd. (“BEL”) and John Benbow (“Benbow”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence, between the dates of, or about, July 31, 2017, and February 21, 2018, regarding two new homes in Whistler, B.C. (the “New Homes”). On February 21, 2018, BCH issued Compliance Order 18-0014 to BEL and Benbow directing that BEL and Benbow:

Bene (No. 4) Development Ltd. (“BDL”) and Ming Nan Li (“Li”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between June 3, 2024, and March 14, 2025, with respect to a main home and a laneway home under construction in Vancouver, BC (collectively, the “New Homes”).

Bennefield Construction Ltd. (“BCL”) and Blue Beaudry Bennefield (“Bennefield”), built or caused to have built a new home in Cobble Hill, BC (the “New Home”), during the period of, or about, October 26, 2018, and April 10, 2019.

Blake Clinton Michaud (“Michaud”) and Deborah Shirley Armstrong (“Armstrong”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Courtenay, BC (the “New Home”), during the period of, or about, August 23, 2018, and December 3, 2019, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Bradley Alan Jennings (“B. Jennings”) and Jeanne Marie Jennings (“J. Jennings”) (together, the “Jennings”), contrary to section 19(1) Homeowner Protection Act Regulation (the “Regulations”) (as it read prior to November 19, 2007), built a duplex in Sun Peaks, B.C., (the “Duplex”), containing two attached dwelling units under stratified properties, for which an Owner Builder Declaration and Disclosure Notice (“OBDDN”) had been issued authorizing the construction of a new single-detached dwelling unit under one legal title.

Bradshaw Construction (1995) Ltd. (“BCL) and Russell Dale Bradshaw (“Bradshaw”), built or caused to have built a new home in Duncan, BC (the “New Home”), during the period of, or about, May 16, 2018, and November 19, 2018 BCL and Bradshaw are a BC Housing (“BCH”) Licensed Residential Builder (“LRB”)(28128) and obtained a commitment from an approved home warranty insurer on May 16, 2018, to provide home warranty insurance (“HWI”) on the New Home as required by the Homeowner Protection Act (the “Act”) and the

Brandy Koch-Zigler (“Koch-Zigler”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced, or caused to have commenced, construction on a new home in Cluculz Lake, BC (the “New Home”), between the period of, or about, January 18, 2018, and November 24, 2021, without being a BC Housing (“BCH”) Licensed Residential Builder (LRB) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Breeze Properties Ltd.(“BPL”), James Stephen Brown (“Brown”), John Weldon Lane (“Lane”), and S. Douglas Mazurek (“Mazurek”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid Residential Builder Licence between the dates of, or about, October 29, 2012, and December 15, 2016, regarding a 30-unit residential development in Penticton, B.C.

Brian Aikins (“B. Aikins”) and Debra Marie Aikins (“D. Aikins”) (together “the Aikinses”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act(the “Act”), constructed a new home in or near Chase, B.C. (the “New Home”), between the period of, or about, February 9, 2012, and September 22, 2015, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Brian Mathew Elson (“B. Elson”) and Louise Elson (“L. Elson”) (together ,“the Elsons”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in or near Chase, B.C.

Broad Base Holdings Inc., (“BBH”), Peter McDonald (“P. McDonald”), and Julie McDonald (“J.

Bruce Warren Bell (“Bell”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Golden, BC (the “New Home”), between the period of, or about, August 17, 2001, and February 13, 2020, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Bryco Enterprises Ltd. (“BEL”) and Bryan James Halbauer (“Halbauer”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Terrace, B.C. (the “New Home”), between the period of, or about, June 23, 2015 and December 29, 2015, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Burkard Developments Ltd. (“BDL”) and David John Burkard (“Burkard”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, September 9, 2024, and June 16, 2025, with respect to a new home in Port Renfrew, BC (the “New Home”). On June 16, 2025, BCH issued Compliance Order 25-0004 to BDL and Burkard directing that BDL and Burkard:

BV Developments Management Inc. (“BV Developments”) and Jun Qi (“Qi”), contrary to section 4.04 of the Homeowner Protection Act Regulation (the “Regulation”), commenced construction on a Part 9 residential building in Langford, BC (the “New Home”) sometime between March 2021 and October 2021 while holding a BC Housing (“BCH”) residential builder license as a developer only and without either qualifying as a general contractor with BCH or hiring a person who holds a residential builder

By Design Construction Inc. (“BDC”) and Bhajan Purba (“Purba”) constructed a new home in Burnaby, BC (the “New Home”), between the period of, or about, August 25, 2016, and June 24, 2017.

C. Large Construction Ltd. (“CLCL”) and Christopher Large (“Large”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Qualicum Beach, B.C. (the “New Home”), during the period of, or about, February 2012 and March 2013, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance.

Carla Judith Meckling (“Meckling”) and Christina Mary Tew (“Tew”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Silverton, BC (the “New Home”), during the period of, or about, August 15, 2017, and July 25, 2019, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.
