Compliance Order

Richard Stanley Graham Davies (“R. Davies”) and Barbara Louise Davies (“B. Davies”) (together, the “Davies”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Golden, B.C. (the “New Home”) in, or around, 2009, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Rick McGrath Holdings Ltd. (“RMHL”) and Ryan McGrath (“McGrath”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced, or caused to have commenced, construction on a new home on Gambier Island, BC (the “New Home”), sometime prior to May 22, 2025, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Ritta Lillian Orlinis (“R. Orlinis”) and Gary Alan Orlinis (“G. Orlinis”) (together, the “Orlinis”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home on Texada Island, BC (the “New Home”), during the period of, or about, 2006 and 2007, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance. On July 5, 2012, Compliance Order 12-0040 was issued by the HPO to R. Orlinis and G.

Riverdell Adventures Inc. (“RAI”) and Nancy Alison Koch (“Koch”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on two new homes in Beaverdell, BC (the “New Homes”), sometime between the period of, or about, August 24, 2020, and October 29, 2021, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Homes being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Robert Allen Stromdahl (“R. Stromdahl”) and Sharon Stromdahl (“S. Stromdahl”) together the (“Stromdahls”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “ Act”), built a new home in Terrace, B.C. (the “New Home”), during the period of February 02, 2007, and April 19, 2012, without being an Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by home warranty insurance.

Robert Brandstetter (“R. Brandstetter”) and Amy Schmid-Brandstetter (“A. Schmid-Brandstetter”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Moricetown, BC (the “New Home”), on, or sometime prior to, December 22, 2015, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Robert Carnduff (“Carnduff”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “ Act”), built a new home in Central Saanich, B.C., (the “New Home”) between sometime before May 27, 2011 and March 27, 2012, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance.

Robert James Weeks (“Weeks”) and Martha Trinh Tran (“Tran”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home on Hornby Island, B.C. (the “New Home”), during the period of July 16, 2009 and April 13, 2012, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance.

Robert Jay Woods (“Woods”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home located in Fruitvale, BC (the “New Home”), sometime around June 2021 without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On March 14, 2023, BCH issued Compliance Order 23-0001 to Woods directing that Woods:  

Robert Milanovic (“R. Milanovic”) and Adam Mackenzie Milanovic (“A. Milanovic”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, November 5, 2020, and October 20, 2021, regarding a new home in Okanagan Falls, BC (the “New Home”). On October 20, 2021, BCH issued Compliance Order 21-0021 to R. Milanovic and A. Milanovic directing that R. Milanovic and A. Milanovic:

Robert Neil Van Brocklin (“Van Brocklin”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Sayward, BC (the “New Home”), between the period of, or about, June 20, 2014 and January 2021, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Robert Walter Reisig, contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Naramata, B.C. (the “New Home”), between the period of, or about, September 28, 2015, and July 18, 2018, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance (“HWI”). On July 18, 2018, BCH issued Compliance Order 18-0050 to Reisig directing that Reisig:

Robin Jay Casey (“R. Casey”) and Josephine Daphne Casey (“J. Casey”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Terrace, B.C. (the “New Home”), on, or sometime prior to, February 17, 2016, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On June 16, 2017, BCH issued Compliance Order 17-0024 to R.

Robin Kumar (“R. Kumar”) and Rohini Kumar (“Ro. Kumar”) (together, the “Kumars”), contrary to section 20.1(1)(b) of the Homeowner Protection Act (the “Act”), regarding a new home in Richmond, BC (the “New Home”), for which an Owner Builder Authorization (“OBA”) had been issued, offered for sale the New Home without having occupied the New Home for the 12 month period after the New Home was built. On July 23, 2014, the Homeowner Protection Office (“HPO”) issued Compliance Order 14-0049 to the Kumars directing that the Kumars:

Rodney Jay Sawatsky (“Sawatsky”) dba Prime Time Enterprises, contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence, between the dates of, or about, December 31, 2017, and March 16, 2018, with respect to two new homes, one in West Kelowna and one in Summerland, B.C. (collectively, the “New Homes”). On March 16, 2018, BCH issued Compliance Order 18-0025 to Sawatsky directing that Sawatsky:

Ronald Leroy Rennie (“Rennie”) and Jeanie Margaret Graffunder (“Graffunder”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced, or caused to have commenced, construction on a new home in Sicamous, BC (the “New Home”), between the period of, or about, February 22, 2017, and November 27, 2019, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Russel David Schartner (“R. Schartner”), contrary to section 22(1.1)(b) of the Homeowner Protection Act (the “Act”), sold a new home in Vernon, BC (the “New Home”), on, or about, November 2, 2016, without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On August 18, 2017, BC Housing (“BCH”) issued Compliance Order 17-0028 to R. Schartner directing that R. Schartner:

Ryan Lee Davies (“Davies”) dba R Davies Developments (“RDD”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Eagle Bay, B.C.

Ryan Robert Kennedy (“R. Kennedy”), Michael Robert Kennedy (“M. Kennedy”) and Gwendolyn Leslie Kennedy (“G.

Ryan Ward (“R. Ward”), contrary to section 20(1) of the Homeowner Protection Act (the “Act”) and section 4.1(2)(e) of the Homeowner Protection Act Regulation (the “Regulations”), regarding a new home in Victoria, B.C. (the “New Home”), for which an Owner Builder Authorization (“OBA”) had been issued, failed to maintain a registered interest in the land on which the New Home was built for at least one year from the date of first occupancy. On March 9, 2017, BC Housing (“BCH”) suspended the OBA that had been issued to R. Ward for the New Home.
