Compliance Order

Ronald Leroy Rennie (“Rennie”) and Jeanie Margaret Graffunder (“Graffunder”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced, or caused to have commenced, construction on a new home in Sicamous, BC (the “New Home”), between the period of, or about, February 22, 2017, and November 27, 2019, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Russel David Schartner (“R. Schartner”), contrary to section 22(1.1)(b) of the Homeowner Protection Act (the “Act”), sold a new home in Vernon, BC (the “New Home”), on, or about, November 2, 2016, without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On August 18, 2017, BC Housing (“BCH”) issued Compliance Order 17-0028 to R. Schartner directing that R. Schartner:

Ryan Lee Davies (“Davies”) dba R Davies Developments (“RDD”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Eagle Bay, B.C.

Ryan Robert Kennedy (“R. Kennedy”), Michael Robert Kennedy (“M. Kennedy”) and Gwendolyn Leslie Kennedy (“G.

Ryan Ward (“R. Ward”), contrary to section 20(1) of the Homeowner Protection Act (the “Act”) and section 4.1(2)(e) of the Homeowner Protection Act Regulation (the “Regulations”), regarding a new home in Victoria, B.C. (the “New Home”), for which an Owner Builder Authorization (“OBA”) had been issued, failed to maintain a registered interest in the land on which the New Home was built for at least one year from the date of first occupancy. On March 9, 2017, BC Housing (“BCH”) suspended the OBA that had been issued to R. Ward for the New Home.

S A S Johal Enterprises Inc. (“SAS”) and Avtar Singh Johal (“Johal”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without being a Homeowner Protection Office ("HPO") Licensed Residential Builder ("LRB") between the dates of May 2, 2014, and October 16, 2014, regarding a new home in Burnaby, BC (the “New Home”). On October 27, 2014, the HPO issued Compliance Order 14-0060 to SAS and Johal directing that SAS and Johal:

Sanraj Holdings & Development Ltd. (“SHD”) and Bijay Ram (“B. Ram”) commenced, or caused to have commenced, construction on two new homes in Chilliwack, BC (the “New Homes”), on, or about, November 30, 2011, and have remained as the registered owner of the New Home properties (the “Properties”) since, or about, May 8, 2018. Although SHD and B.

Savinder Gill ("Gill"), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Surrey, B.C., (the “New Home), during the period of May 2005 to July 2007, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered with home warranty insurance. On August 4, 2009, Compliance Order 09-0014 was issued by the HPO to Gill directing that Gill become an HPO LRB and obtain home warranty insurance for the New Home.

Shanne Clinton Bushey (“Bushey”) and Raelene Adrienne Vandenbosch (“Vandenbosch”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), built a new coach home in Squamish, B.C. (the “New Home”), between September 30, 2011, and November 9, 2012, without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Sharlene Gail Raffard (“S. Raffard”), contrary to section 20.1(1)(b) of the Homeowner Protection Act (the “Act”), regarding a new home in West Vancouver, BC (the “New Home”), for which an Owner Builder Authorization ( “OBA”) had been issued, offered for sale the New Home without having occupied the New Home for the 12 month period after the New Home was built. On May 29, 2014, the Homeowner Protection Office (“HPO”) issued Compliance Order 14-0041 to S. Raffard directing that S. Raffard:

Shawn Hull (“Hull”), contrary to section 20(1)(a) of the Homeowner Protection Act (the “Act”) and section 4.1(2)(e) of the Homeowner Protection Act Regulation (the “Regulations”), regarding a new home in Vancouver, B.C. (the “New Home”), for which an Owner Builder Authorization (“OBA”) had been issued, failed to maintain a registered interest in the land on which the New Home was built for at least one year from the date of first occupancy. On May 14, 2013, the Homeowner Protection Office (“HPO”) suspended the OBA that had been issued to Hull.

Sherry Lynn Violet Zielinski (“Zielinski”), contrary to section 22(1.1) of the Homeowner Protection Act (the “Act”), offered for sale a new home in Prince George, B.C. (the “New Home”), between the dates of, or about, August 29, 2014, and October 16, 2014, without the New Home being covered with a policy of home warranty insurance pursuant to section 22(1) of the Act.  On October 8, 2014, the Homeowner Protection Office (“HPO”) issued Compliance Order 14-0055 to Zielinski directing that Zielinski:

Shiqi Zhou (“S. Zhou”), Zongxum Zhou (“Z. Zhou”) and 0913443 B.C. Ltd. dba Arzone Real Estate Investment Ltd. (“AREIL”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”), between the dates of, or about, January 14, 2013, and February 11, 2014, regarding a residential development in Blind Bay, B.C.

Siltstone Contracting Ltd. (“SCL”), Vikramjit Singh (“Singh”), and Lakhvinder Kaur (“Kaur”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence, between the dates of, or about, February 28, 2017, and February 20, 2018. On February 20, 2018, BCH issued Compliance Order 18-0013 to SCL, Singh and Kaur directing that SCL, Singh and Kaur:

Sodhi Dadral (“S. Dadral”) and Neelam Dadral (“N. Dadral”), contrary to section 14(1) of the Homeowner Protection Act (“ Act”),  sold a new home in Vancouver, B.C. (“New Home 1”) on, or about, March 30, 2012 and offered/ marketed for sale another new home in Vancouver, BC (“New Home 2”), between the dates of, in, or about, February 2012, and May 25, 2012, without a valid Homeowner Protection Office (“HPO”) Licence. On May 25, 2012, the HPO issued Compliance Order 12-0029 to S. Dadral and N.

Spiketop Cedar Ltd. (“SCL”), James Edward Burgess (“J. Burgess”), and Karen Lee Burgess (“K. Burgess”) (together, “the Burgesses”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced construction on a new home in Port Hardy, B.C. (the “New Home”), on, or about, June 11, 2014, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered with a policy of home warranty insurance.

Steele Jordan (“Jordan”) and Humming Bird Resort Ltd. (“HBRL”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and offered/ marketed for sale 18 new homes in Mara, B.C. (collectively, the “New Homes”), between the dates of, or about, April 26, 2011, and February 11, 2014.

Stephane Noel Desautels (“Desautels”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Tappen, B.C. (the “New Home”), on, or sometime prior to, October 6, 2015, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On June 14, 2017, BCH issued Compliance Order 17-0022 to Desautels and directing that Desautels:

Stephen Gary Lamarche (“Lamarche”), Patrick John Fines (“Fines”) and Kenneth David Suchan (“Suchan”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act ( the “ Act”), built a new home in or near Valemount, B.C. (the “New Home”), during the period of November 18, 2010 and May 24, 2012, without being an Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by home warranty insurance.

Sterling Hunt (GP) Ltd. (“SHL”), George Mason (“G. Mason”), and Robert Arthur Forrest (“R. Forrest”), contrary to section 22(1.1)(a) of the Homeowner Protection Act (the “Act”), offered and marketed for sale 3 multi-unit buildings in Merritt, BC, containing approximately 14 residential units (collectively, the “New Homes”), without any of the New Homes being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider in, or about, February 2018.
