Compliance Order

Terry Michael Michaels (“Michaels”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced, or caused to have commenced, construction on a new home in Salt Spring Island, BC (the “New Home”), sometime prior to November 7, 2023, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On February 29, 2024, BCH issued Compliance Order 24-0003 to Michaels directing that Michaels:

Teth Margaret Haddow (“Haddow”), Charles Curtis (“C. Curtis”) and Lindsay Curtis (“L. Curtis”) (C. Curtis and L. Curtis together, the “Curtises”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Winlaw, B.C.

The Statesman Pine Ridge Mountain Resort Partnership (“the Partnership”), Statesman Developments (B.C.) Ltd. (“SDL”), Metro Recreation Properties Ltd. (“MRPL”), Garth Mann (“G. Mann”), and Jeff Garth Mann (“J.

Timothy Mascarenhas (“Mascarenhas”) and Steelewood Builders Inc. (“SBI”) constructed a new home in Blind Bay, B.C. (the “New Home”), between the period of, or about, January 14, 2009, and January 23, 2012.

Todd Andrew Thomson (“Thomson”), contrary to sections 20.1(1)(b) and 21(2)(a) of the Homeowner Protection Act (the “Act”), regarding a new home in Coquitlam, B.C. (the “New Home”), for which an Owner Builder Authorization (“OBA”) had been issued, sold the New Home prior to one year from first occupancy, and failed to provide the purchaser of the New Home with a disclosure notice, in a form satisfactory to the Homeowner Protection Office (“HPO”) Registrar, stating among other facts, whether or not the New Home was covered by home warranty insurance.

Tongue and Groove Construction Ltd. (“TGC”), Justin Terry Unrau (“Unrau”)and Nathan Edward Mattern (“Mattern”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), constructed a new home in Terrace, B.C. (the “New Home”), between the period of, or about, August 24, 2017, and March 2, 2018, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Trafalgar Homes Ltd. (“THL”) and Byron James Schofield (“Schofield”) constructed a new home on Mayne Island, B.C. (the “New Home”), during the period of, or about, March 23, 2013, and July 15, 2015.

Travis Cody Kerluck (“T. Kerluck”) and Benjamin David Lloyd Kerluck (“B. Kerluck”)(together, “the Kerlucks”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Campbell River, BC (the “New Home”), sometime between the period of, or about, June 25, 2020, and June 2, 2022, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Trevor Lee Mosher (“Mosher”), contrary to section 14(1) and section 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Hudson’s Hope, B.C., (the “New Home”), during the period of, or about, 2009 and 2013, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”), and without the New Home being covered by a policy of home warranty insurance. On January 18, 2013, the HPO issued Compliance Order 13-0001 to Mosher directing that Mosher:

Trevor Wesley Stevenson (“T. Stevenson”)and Karen Mae Stevenson (“K. Stevenson”) (together, “the Stevensons”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Courtenay, B.C. (the “New Home”), between the period of, or about, 2009 and September 24, 2014, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance.

Triple E Holdings Ltd. (“TEHL”), Elizabeth June Eby (“Eby”), Kham Galen Shantz (“Shantz”), and Brian Jade Kiesman (“Kiesman”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), constructed, or caused to have constructed, a new home in Lakelse Lake, B.C.

U.K. Gill Corp. (“UGC”), Rajinder S. Gill (“R. Gill”), and Nilam Gill (“N. Gill”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, October 31, 2018, and April 3, 2019, regarding two new homes in Abbotsford, BC (the “New Homes”). On April 3, 2019, BCH issued Compliance Order 19-0003 to UGC, R. Gill and N. Gill directing that UGC, R. Gill and N. Gill:

V.I.C. Investments Inc. (“VIC”), Wayne William Arnold (“W. Arnold”), and Elyane Maria Del Carmen R. Arnold (“E. Arnold”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced construction on a new home in Zeballos, BC (the “New Home”), sometime in 2012 without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Valerie Spearing (“Spearing”), contrary to section 22(1.1) of the Homeowner Protection Act (the “Act”), offered for sale a new home in Port Coquitlam, B.C. (the “New Home”), between the dates of March 17, 2014, and March 27, 2014, without the New Home being covered with a policy of home warranty insurance pursuant to section 22(1) of the Act.  On March 27, 2014, the Homeowner Protection Office (“HPO”) issued Compliance Order 14-0025 to Spearing directing that Spearing:

Vicki Jeanne Lum (“Lum”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and offered/ marketed for sale five new homes in Vancouver, BC (collectively, the “New Homes”), between the dates of, or about, March 21, 2013, and July 17, 2013. On July 17, 2013, the HPO issued Compliance Order 13-0033 to Lum, directing that Lum:

Violeta Developments Ltd. (“VDL”), Violeta Maria Perez (“Perez”), Mandeep Kumar Ranga (“Ranga”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), built a coach home and a main home in Vancouver, B.C. (collectively, the “New Homes”), during the period of, or about, June 23, 2016, and August 28, 2017, without any of the New Homes being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Watton Homes Ltd. (“WHL”) and Ron Watton (“Watton”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder between the period of, or prior to, December 29, 2015, and March 24, 2016, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”). On March 24, 2016, the HPO issued Compliance Order 16-0011 to WHL and Watton directing that WHL and Watton:

Werner Schuck Construction (1997) Ltd. - 5 counts of failing to provide home warranty insurance.
Penalty: $5,000.

West Rim Construction (“WRC”) and Guy Michael John Scrugham (“Scrugham”), contrary to section 14(5)(b) of the Homeowner Protection Act (the “Act), published information implying and suggesting that WRC and/or Scrugham is a licensed residential builder during the period of, or about, September 1, 2022, and June 2, 2023, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”). On June 2, 2023, BCH issued Compliance Order 23-0011 to WRC and Scrugham directing that WRC and Scrugham immediately either:

Wild West Log Homes Ltd. (“WWLHL”) and Todagin Russell Hodson (“Hodson”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced, or caused to have commenced, construction on a new home in Rose Prairie, B.C. (the “New Home”), sometime between September 7, 2012 and June 15, 2013, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.
