Compliance Order

Marlin Orthner Construction (“MOC”) and Marlin Jacob Orthner (“M. Orthner”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) between the period of, or about, November 2019 and August 2022, regarding four new homes in Maple Ridge, BC (collectively, the “New Homes”). On September 2, 2022, BCH issued Compliance Order 22-0012 to MOC and M. Orthner directing that MOC and M. Orthner:  

Marni Jo Thorpe (“Thorpe”), contrary to section 22(1.1)(b) of the Homeowner Protection Act (the “Act”), offered and marketed for sale a new home in West Kelowna, B.C. (the “New Home”), without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider in, or about, August 2017. On February 26, 2018, BC Housing (“BCH”) issued Compliance Order 18-0007 to Thorpe directing that Thorpe:

Matthew Huber (“Huber”), contrary to 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Abbotsford, BC (the “New Home”), during the period of, or about, May 11, 2017, and November 7, 2017, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home currently being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On November 7, 2017, BCH issued Compliance Order 17-0039 to Huber directing that Huber:

Matthew Lopez (“Lopez”) and Matthew Lopez Contracting Ltd. (“MLCL”), contrary to section 14(5)(b) of the Homeowner Protection Act (the “Act”), published information implying and suggesting that Lopez and MLCL are BC Housing (“BCH”) Licensed Residential Builder (“LRB”), and contrary to section 14(1) of the Act, conducted the business of a residential builder without being a BCH LRB between the period of, or about, September 25, 2019 and July 22, 2020, regarding a new home in North Saanich, BC (the “New Home”).

Matthew Thomas Renfrow (“Renfrow”) and 0914603 B.C. Ltd.

Maya Homes Ltd. (“MHL”), and Sukhdip S Hayre (“Hayre”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, May 31, 2022, and October 12, 2022, regarding a new home in Coquitlam, a new home in White Rock, and two new homes in Surrey, BC (collectively, the “New Homes”). On October 12, 2022, BCH issued Compliance Order 22-0024 to MHL and Hayre directing that MHL and Hayre: 

Mehak Bassi (“Bassi”) and Shansher Singh Bharaj (“Bharaj”), contrary to section 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Chilliwack, B.C. (the “New Home”) during a period of, or about, September 28, 2007, and May 29, 2012, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance.

Michael James Ahlm (“M. Ahlm”), contrary to section 14(1) of the Homeowner Protection Act (“Act”), regarding two new homes in Salmon Arm, B.C., (the “New Homes”) conducted the business of a residential builder without a Homeowner Protection Office (“HPO”) Residential Builder Licence by offering and/or marketing for sale the New Homes between the dates of, on or before, December 7, 2011, and February 13, 2012. On February 13, 2012, the HPO issued Compliance Order 12-0005 directing M.

Michael Nathan West (“M. West”) and Judy Elizabeth West (“J. West”) (together “the Wests”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), constructed a new home in Lac La Hache, B.C. (the “New Home”), between the period of, or about, July 21, 2010, and June 16, 2015, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Michael Stephen Hanson (“Hanson”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced, or caused to have commenced, construction on a new home in Cluculz Lake, BC (the “New Home”), between the period of, or about, April 24, 2018, and July 19, 2019, without being a BC Housing (“BCH”) Licensed Residential Builder (LRB) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.  Although BCH received an application for an Owner Builder Authoriza

Minder Bhullar (“Bhullar”) and Balwant Singh Sran (“Sran”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in New Westminster, B.C. (the “New Home”), between the period of, or about, November 20, 2014, and April 20, 2017, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Moninder Singh Bual (“M. Bual”) and Dalvinder Kaur Bual (“D. Bual”) (together, “the Buals”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in Surrey, B.C. (the “New Home”), between the period of, or about, January 17, 2014, and July 21, 2014, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance.

Moshe Lyndon Wallenberg Demers (“M. Demers”) and Hannah Sioban Demers (“H. Demers”)(together, “the Demerses”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced construction of a new home in Blewett, BC (the “New Home”), sometime prior to May 12, 2021, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Mountain West Construction Ltd. (“MWCL”), Donald Neufeldt (“D. Neufeldt”), and Elly Neufeldt (“E. Neufeldt”) constructed a new home in Langley, BC (the “New Home”) during the period of, or about, June 22, 2015, and January 7, 2016.

Mustak Ahmed Gani Buksh (“Buksh”), contrary to section 22(1.1) of the Homeowner Protection Act (the “Act”), offered for sale a new home in Chilliwack, BC (the “New Home”), between the dates of January 30, 2013 and June 25, 2013, without the New Home being covered with a policy of home warranty insurance pursuant to section 22 of the Act.  On June 25, 2013, the Homeowner Protection Office (“HPO”) issued Compliance Order 13-0029 to Buksh directing that Buksh:

Myhomedesigner.com Ltd. (“MCL”) and Aryo Falakrou (“Falakrou”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), built or caused to have built a new home in West Vancouver, BC (the “New Home”) between July 22, 2011, and January 30, 2012, without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On April 10, 2013, the HPO issued Compliance Order 13-0011 to MCL and Falakrou directing that MCL and Falakrou:

Nabob Homes Ltd. (“Nabob”), 0852845 B.C. Ltd. (“0852845”), and Manjit Rai (“M. Rai”), constructed a new home in Maple Ridge, B.C. (the “New Home”), between the dates of April 29, 2011, and February 14, 2014.

Nancy Ann Lizuck (“Lizuck”) and Yann Le Scieller (“Scieller”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Passmore, BC (the “New Home”), in, or about, 2013, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Nancy Ceridwen Griffiths (“N. Griffiths”), Sheila Myrtle Griffiths (“S. Griffiths”), Gordon Gabriel Griffiths (“G. Griffiths”), and Francine Maria Griffiths (“F. Griffiths”) (together, the “Griffiths”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Winlaw, B.C.

Narinder Lally (“N. Lally”) and Gaurav Lally (“G. Lally”) (together, “the Lallys”) commenced and continued construction on a new home in Surrey, B.C. (the “New Home”), between the period of, or about, January 18, 2018, and June 11, 2018.
