Compliance Order

Jagpal Development Ltd. (“JDL”), Navjote Singh Jagpal (“Navjote J.”), Navepal Singh Jagpal (“Navepal J.) and Randeep Johal (“Randeep J.”), contrary to section 14(5)(b) of the Homeowner Protection Act (the “Act”), published information implying and suggesting that JDL, Navjote J., Navepal J., and/or Randeep J. is a licensed residential builder during the period of July 29, 2021, and March 23, 2022, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”).

Jagtar Randhawa (“J. Randhawa”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), constructed, or caused to have constructed, a new coach home in Abbotsford, BC (the “New Home”), without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On September 24, 2017, BC Housing (“BCH”) issued Compliance Order 17-0034 to J. Randhawa directing that J. Randhawa to:

James Latham (“Latham”) dba Capital City Construction (“CCC”), contrary to section 14(5)(b) of the Homeowner Protection Act (the “Act”), published information implying and suggesting that Latham and/or CCC is a licensed residential builder during the period of, or about, January 29, 2021 and May 5, 2021, without being a BC Housing (“BCH”) Licensed Residential Builder. On May 5, 2021, Compliance Order 21-0009 was issued by BCH to Latham and CCC, directing that Latham and CCC:

Jamie Christopher Mydaniuk (“Mydaniuk”) and Chrystal Rae Sawry (“Sawry”), built a new home in Bowser, B.C., (the “New Home”) in 2011.

Jamie Lee Fahselt, Clayton Gordon Fahselt, Travis Odell Fahselt, Melissa Joy Fahselt, Sharyl Lynn Fahselt, Brian Odell Fahselt, Lynda Corrine Czernicki, Lesley Lavern Czernicki, Norine Dawn McLennan, and Lance Scott McLennan (together, “the Owners”), contrary to section 22(1.1)(b) of the Homeowner Protection Act (the “Act”), offered for sale a new home in Jaffray, B.C. (the “New Home”), without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Jasbir Singh Mehta (“J. Mehta”) and Rupinder Mehta (“R. Mehta”) (together, “the Mehtas”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Surrey, B.C. (the “New Home”), on, or about, January 18, 2018, without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider. On June 11, 2018, BC Housing (“BCH”) issued Compliance Order 18-0042 to the Mehtas directing that the Mehtas:

Jasleen Kaur Hare (“J. Hare”) and Kuldeep Kaur Hare (“K. Hare”) (together, “the Hares”), contrary to sections 20.1(1)(a) and 21(2)(b) of the Homeowner Protection Act (the “Act”), regarding a new home in Richmond, B.C.

Jason Neil Butler (“J. Butler”) and Cristina Michelle Butler (“C. Butler”) ( together, the “Butlers”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Prince George, BC (the “New Home”), in, or about, 2011, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Jason Osborn (“Osborn”) contrary to subsections 20.1(1)(b) of the Homeowner Protection Act (the "Act"), built a new home in Prince George, B.C., (the "New Home"), for which an Owner Builder Authorization (the "OBA")had been issued, and sold the New Home without having occupied the New Home for the 12-month period after the New Home was built. On October 14, 2011, the Homeowner Protection Office ("HPO") Registrar cancelled the OBA.

Jaspaul Shergill (“Shergill”), contrary to sections 20.1(1)(b) and 21(2)(a) of the Homeowner Protection Act (the “Act”), regarding a new home in Surrey, B.C. (the “New Home”), for which an Owner Builder Authorization (“OBA”) had been issued, sold the New Home prior to one year from first occupancy, and failed to provide the purchaser of the New Home with a disclosure notice, in a form satisfactory to the Homeowner Protection Office (“HPO”) Registrar, stating among other facts, whether or not the New Home was covered by home warranty insurance.

Jatinder Singh Dhaliwal (“J. Dhaliwal”), contrary to section 21(2)(a) of the Homeowner Protection Act (the “Act”), regarding a new home in Surrey, B.C. (the “New Home”), for which an Owner Builder Authorization (“OBA”) had been issued, failed to provide the purchasers of the New Home with a disclosure notice, in a form satisfactory to the Homeowner Protection Office (the “HPO”) Registrar, stating among other facts, whether or not the New Home was covered by home warranty insurance. On April 25, 2016, the HPO issued Compliance Order 16-0022 to J.

Jean Hayek (“Hayek”) and Keen Construction Limited (“KCL”), contrary to section 14(5)(b) of the Homeowner Protection Act (the “Act”), published information implying and suggesting that Hayek, and/or KCL is a licensed residential builder during the periods of June 24, 2020 and February 3, 2021, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”). On February 3, 2021, Compliance Order 21-0006 was issued by BCH to Hayek and KCL, directing that Hayek and KCL: 

Jeet Singh Bhatti (“J.S. Bhatti”) and Jaswinder Kaur Bhatti (“J.K. Bhatti”) (together, the “Bhattis”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built, or caused to have built, a new home in Nanaimo, B.C. (the “New Home”), during the period of, or about, 2005 and 2006, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance.

Jeffery Russell (“Russell”), contrary to sections 20.1(1)(a) and 21(2)(a) of the Homeowner Protection Act (the “Act”), regarding a new home in Winfield, B.C. (the “New Home”), for which an Owner Builder Authorization had been issued, sold the New Home while it was being constructed, and failed to provide the purchasers of the New Home with a disclosure notice, in a form satisfactory to the Homeowner Protection Office (the “HPO”) Registrar, stating among other facts, whether or not the New Home was covered by home warranty insurance.

Jeffrey Bruce Franklin (“Franklin”) contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Chetwynd, B.C. (the “New Home”) in, or around, September 2011, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On April 24, 2014, the HPO issued Compliance Order 14-0034 to Franklin directing that Franklin:

Jeremy Henk Goosen (“Goosen”), contrary to section 20.1(1)(b) of the Homeowner Protection Act (the “Act”), sold a new home in Chilliwack, B.C. (the “New Home”), for which an Owner Builder Authorization (“OBA”) had been issued, without having occupied the New Home for the 12-month period after it was built. On May 15, 2013, the Homeowner Protection Office (“HPO”) cancelled the OBA that had been issued to Goosen for the New Home. On March 21, 2014, the HPO issued Compliance Order 14-0023 to Goosen, directing that Goosen:

Jeremy James Simonson (“Simonson”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) between the period of, or about, August and September 2023, regarding a new home in Vernon, BC (the “New Home”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) since the New Home was de-enrolled from HWI coverage on  September 13, 2023, contrary to section 22(1) of the Act.

Jessie MacCosham (“MacCosham”), contrary to section 22(1.1)(b) of the Homeowner Protection Act (the “Act”), offered for sale a new home in Vancouver, B.C. (the “New Home”), between the dates of April 25, 2013 and June 13, 2013, without the New Home being covered with a policy of home warranty insurance pursuant to section 22 of the Act.  On June 13, 2013, the Homeowner Protection Office (“HPO”) issued Compliance Order 13-0028 to MacCosham directing that MacCosham:
