Compliance Order

Jon Andrew Holmberg (“Holmberg”) and Lorraine Lise Boksa (“Boksa”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced, or caused to have commenced, construction on a new home in Inonoaklin Valley, BC (the “New Home”), sometime prior to November 14, 2023, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

On April 19, 2012, pursuant to s. 28.3(1)(a) of the Homeowner Protection Act (the “Act”), and s.20.1(2)(d) and s. 20.1(2)(e) of the Homeowner Protection Act Regulation (the “Regulations”), Jonathan Soderman Christensen (“J. Christensen”) and Ashley Margaret Juliet Christensen (“A. Christensen”) (together, the “Christensens”) were issued a monetary penalty, jointly and severally, in the single amount of $750.

Jonathan Wayne Sissons (“J. Sissons”) and Laurie Ann Sissons (“L. Sissons”)(together, “the Sissonses”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act), built or caused to have built a new home in Hagensborg, BC (the “New Home”), sometime between the period of, or about, August 2021 and November 2021, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Joseph Francois Duperron (“Duperron”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Osoyoos, B.C. (the “New Home”), during the period of, or about, March 8, 2010 and November 16, 2012, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance. On December 18, 2012, Compliance Order 12-0049 was issued by the HPO to Duperron directing that he:

Judah Heron (“Heron”), contrary to section 14(1) and 22 (1) of the Homeowner Protection Act (the “Act”), built a new home in Qualicum, B.C. (the “New Home”), between the dates of, or about, July 11, 2012, and August 19, 2013, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being covered by a policy of home warranty insurance. On August 19, 2013, the HPO issued Compliance Order  13-0036 to Heron directing that Heron:

Judith L. Kwiatkowski (“J. Kwiatkowski”), Dennis Kwiatkowski (“D. Kwiatkowski”) (together, “the Kwiatkowskis”), and BC0385770 dba Denny’s Woodwork & Construction Ltd. (“DWCL”)  constructed a new home in Quesnel, BC (the “New Home”), between the period of, or about, July 29, 2011, and May 6, 2013.

Juhl Campbell (“J. Campbell”), contrary to section 22(1.1) (b) of the Homeowner Protection Act (the “Act”), offered/ marketed for sale two new homes in Boswell, B.C. (the “New Homes”), between the dates of April 7, 2012 and June 20, 2012, without either of the New Homes being covered with a policy of home warranty insurance pursuant to section 22 of the Act. On July 23, 2012, the Homeowner Protection Office (“HPO”) issued Compliance Order 12-0038 to J.

Justin Daniel Von Lienen (“Von Lienen”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Tappen, B.C. (the “New Home”), between the period of, or about, September 21, 2012, and September 23, 2015, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Kanani Development Ltd. (“KDL”), Inderjit Singh Basra (“I. Basra”), and Jasbir Singh Basra (“J. Basra”), contrary to section 22(1) of the Homeowner Protection Act (the “Act”), built a new home in Port Coquitlam, B.C. (the “New Home”), between the period of, or about, February 29, 2012, the date the New Home was de-enrolled from home warranty insurance coverage, and October 2012, without the New Home being covered by a policy of home warranty insurance.

Karine Marie Sylvie Lafreniere (“Lafreniere”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced, or caused to have commenced, construction on a new home in Crawford Bay, BC (the “New Home”), sometime between September 7, 2023 and January 7, 2025, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Karl Heinz Breitlauch (“K. Breitlauch”) and Jan-Sebastian Breitlauch (“J. Breitlauch”) (together, “the Breitlauches”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Horsefly, BC (the “New Home”), in, or around, 2013, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Kashmir Gosal (“K. Gosal”) and Sarabjit Gosal (“S. Gosal”) (together, “the Gosals”), contrary to sections 20.1(1)(b) and 21(2)(a) of the Homeowner Protection Act (the “Act”), regarding a new home in Surrey, B.C.

Kathleen Alexandra Dyck (“Dyck”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Winlaw, B.C. (the “New Home”), sometime prior to October 8, 2014, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance provided by a warranty provider. On February 4, 2015, the HPO issued Compliance Order 15-0007 to Dyck directing that Dyck immediately:

Keith Lasser (“Lasser”) dba Keith Lasser Construction, contrary to section 14(1) of the Homeowner Protection Act (the “Act”), commenced/ continued construction on a new home in Celista, BC (the “New Home”), during the periods of April 2, 2013, and March 21, 2014, without being a Homeowner Protection Office (“HPO”) Licensed Residential Builder (“LRB”). On March 21, 2014, the HPO issued Compliance Order 14-0024 to Lasser directing that Lasser:

On January 24, 2018, pursuant to s. 28.3(1)(b) of the Homeowner Protection Act (the “Act”), Ken Babakaiff (“K. Babakaiff”), David Kenneth Babakaiff (“D. Babakaiff”), and Amy Anna-Maria Windson (“A. Windson”), jointly and severally, were issued a monetary penalty in a daily amount of $135, to a maximum of $4,050, for each day that passes until the demands contained in Compliance Order 17-0036 have been satisfied. This Monetary Penalty was issued for the following reasons:

Ken Babakaiff (“K. Babakaiff”), David Kenneth Babakaiff (“D. Babakaiff”), and Amy Anna-Maria Windson (“A. Windson”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Krestova, BC (the “New Home”), sometime in 2017 without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

Kenneth James Campbell (“K. Campbell”) and Doreen Marie Campbell (“D. Campbell”)(together, the “Campbells”), contrary to section 20.1(1)(b) of the Homeowner Protection Act (the “Act”), regarding a new home in Chilliwack, B.C. (the “New Home”), for which an Owner Builder Authorization had been issued, sold the New Home within the 12-month time period after the New Home was built. On April 26, 2013, the Homeowner Protection Office (“HPO”) issued Compliance Order 13-0016 to the Campbells directing that the Campbells:

Kenneth Trevor Joel Oliver (“K. Oliver”) contravened section 22(1) of the Homeowner Protection Act (the “Act”) regarding a new home in Kelowna, B.C. (the “New Home”), during the period of, or about, August 2016 and November 2016. Although K. Oliver has been a BC Housing (“BCH”) Licensed Residential Builder (41311) since January 21, 2016, K. Oliver commenced and continued construction on the New Home without the New Home being registered for coverage by home warranty insurance provided by a warranty provider.

Kevin Roy Peters (“Peters”), contrary to sections 14(1) and 22(1) of the Homeowner Protection Act (the “Act”), commenced or caused to have commenced construction on a new home in Cache Creek, BC (the “New Home”), during the period of, or about, September 24, 2019, and October 24, 2020, without being a BC Housing (“BCH”) Licensed Residential Builder (“LRB”) and without the New Home being registered for coverage by home warranty insurance (“HWI”) provided by a warranty provider.

KNS Investments Inc. (“KNSI”), Shawn Buttle (“Buttle”) and Jaskarn Dhillon (“Dhillon”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, June 30, 2024, and December 31, 2024, with respect to a new home in Ladysmith, BC (the “New Home”).
